Plain-language terms for using ProofNest.
The short version

- ✓Your evidence data stays on your device and belongs to you.
- ✓Optional features (AI letters, blockchain sealing) transmit only the minimum data required.
- ✓Subscriptions auto-renew and are managed through Apple or Google — not us.
- ✓Ontario law governs. Disputes are resolved in Ottawa, Canada.
ACCEPTANCE
Using ProofNest means you agree to these terms.
These Terms of Service (“Terms”) form a binding agreement between you and NerdSnipe Inc., a corporation incorporated in Ontario, Canada (“NerdSnipe,” “we,” “us,” or “our”), governing your access to and use of the ProofNest mobile application and any related services (collectively, the “Service”). By downloading, installing, or using the Service, you confirm that you are at least 13 years old, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the Service.
LICENSE
We grant you a limited, personal right to use the app.
Subject to your compliance with these Terms, NerdSnipe grants you a limited, non-exclusive, non-transferable, revocable license to install and use the ProofNest application on devices that you own or control, solely for your personal or internal business purposes. This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise exploit the Service commercially; to modify, copy, create derivative works of, or reverse-engineer any portion of the Service; to scrape or extract data from the Service by automated means; or to use the Service to build a competing product.
YOUR CONTENT
Your evidence data belongs to you.
Photos, GPS coordinates, timestamps, case notes, and any other content you create or capture using the Service ("Your Content") remain your property. Because ProofNest stores data on-device and has no backend server, NerdSnipe does not access, host, or receive Your Content in the ordinary course of the app's operation. When you use optional features — such as AI-enhanced demand letters or blockchain timestamping — specific text data or a cryptographic hash derived from Your Content may be transmitted to third-party services as described in the Privacy Policy. By using those optional features, you grant NerdSnipe and the applicable third-party services the limited right to process that data solely for the purpose of delivering the requested feature.
ACCEPTABLE USE
Use the Service lawfully and honestly.
You agree to use ProofNest only for lawful purposes and in a way that does not infringe the rights of others. You must not use the Service to fabricate, alter, or misrepresent evidence; to harass, threaten, or defraud any person; to violate any applicable federal, provincial, or local law or regulation; or to capture images or GPS data of individuals without their knowledge where doing so is prohibited by law. You are solely responsible for ensuring that your use of ProofNest — including the evidence you create and any demand letters you send — complies with all applicable laws in your jurisdiction.
IN-APP PURCHASES & SUBSCRIPTIONS
Purchases are final; subscriptions renew automatically.
The Service offers in-app purchases including one-time case unlocks and auto-renewing subscriptions ("Pro Monthly" and "Pro Yearly") processed through Apple App Store or Google Play. All purchases are subject to the payment terms of the applicable platform. Subscription periods renew automatically unless cancelled at least 24 hours before the end of the current period. You may manage or cancel subscriptions through your Apple ID or Google account settings. Except as required by applicable law or the platform's own refund policy, all purchases are non-refundable. NerdSnipe does not process payment directly and does not have access to your payment details.
THIRD-PARTY SERVICES
Some features rely on third-party services we don't control.
ProofNest optionally integrates with Anthropic's API for AI-generated demand letters, and with the OpenTimestamps public calendar server and the Bitcoin network for blockchain timestamping. These are independent services operated by third parties under their own terms and privacy policies. NerdSnipe is not responsible for the availability, accuracy, or actions of these services. Blockchain submissions — specifically, hashes recorded in Bitcoin transactions — are irreversible by design and cannot be deleted or retracted by NerdSnipe or by you once confirmed on-chain.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NerdSnipe does not warrant that the Service will be error-free, uninterrupted, or free of harmful components. Nothing in the Service constitutes legal advice. Demand letters, evidence reports, and blockchain timestamps are documentation tools — their legal sufficiency depends on your specific circumstances, jurisdiction, and the facts of your case. You should consult a qualified lawyer for legal advice. NerdSnipe is not a law firm and does not provide legal services.
LIMITATION OF LIABILITY
Our liability is limited to what you paid us.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NERDSNIPE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES, NERDSNIPE'S TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO NERDSNIPE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) CAD $10.00. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
GOVERNING LAW
Ontario law governs. Disputes resolved in Ottawa.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You irrevocably consent to the exclusive jurisdiction and venue of the courts located in Ottawa, Ontario, Canada for the resolution of any dispute arising out of or relating to these Terms or the Service. If you are a consumer located in a jurisdiction where mandatory consumer-protection law provides different rights, nothing in this clause limits those rights.
TERMINATION
Either party may end this agreement at any time.
You may stop using the Service and delete the app at any time. NerdSnipe may suspend or terminate your access to the Service at any time if you violate these Terms or if we decide to discontinue the Service, with or without notice. Upon termination, your license to use the Service ends immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.
CHANGES TO THESE TERMS
We'll update these terms as the app evolves.
NerdSnipe may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will endeavour to provide notice through the app or by updating the App Store listing. Your continued use of the Service after the revised Terms are posted constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.
